Terms of Service

1. Acceptance of Terms

By accessing or using the Quelori wellness management platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including business operators, staff members, and end-users who interact with the Service through booking widgets or public pages.

2. Description of Service

Quelori provides a cloud-based wellness management platform that includes booking and scheduling, client management, membership and subscription handling, retreat and programme management, hotel PMS integration, analytics, and related tools for wellness businesses.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

4. User Obligations

You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms.
• Not use the Service to store or transmit harmful, fraudulent, or unlawful content.
• Comply with all applicable laws and regulations, including data protection and privacy laws.
• Not attempt to gain unauthorised access to any part of the Service or its systems.
• Not interfere with or disrupt the Service or its infrastructure.
• Ensure that any data you input, including client and guest data, is collected and shared in compliance with applicable laws.

5. Payment Terms

Access to certain features of the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected during registration.

• All fees are quoted in Euros unless otherwise stated.
• Payments are processed through our third-party payment provider.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are handled in accordance with our refund policy. Generally, fees are non-refundable except where required by law.
• We reserve the right to change pricing with 30 days' advance notice.

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Quelori and protected by intellectual property laws. You retain ownership of data you input into the Service.

You grant Quelori a limited licence to use, store, and process your data solely for the purpose of providing and improving the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Quelori shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Termination

You may terminate your account at any time through the account settings or by contacting us. We may suspend or terminate your access if you breach these Terms or if continued provision of the Service is no longer commercially viable.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable member state where Quelori is established. Any disputes shall be resolved in the competent courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
